Dilworth IP’s David Puleo and Dr. Anthony Sabatelli recently had an article featured in the bi-monthly publication IP Litigator. Their article, entitled “UK Supreme Court Redefines Patent Infringement,” considers the United Kingdom Supreme Court decision in Actavis UK Limited and others v. Eli Lilly and Company, and the implications it has on defining patent infringement.

Dilworth IP was a proud sponsor of the 2nd Annual China Pharma Intellectual Property Summit. Dilworth IP’s Michael Dilworth, Anthony Sabatelli and Jing Zhou attended the event, which was held in Shanghai on December 7th and 8th. The summit is an opportunity for in-house counsel members from Chinese pharmaceutical companies to network with intellectual property attorneys from around the world. With laws concerning the pharmaceutical industry continuing to evolve in China, the summit becomes increasingly more important.

Dilworth IP Participates in the Salvation Army’s Angel Tree Program

Dilworth IP proudly participated in the Salvation Army’s Angel Tree Program this Holiday Season. Every Year, the Salvation Army finds children who would otherwise not receive any gifts on Christmas morning, and matches them to donors who are provided with tags that have an individual child’s wish list on them. The donor then returns the tag to the Salvation Army with the gifts they purchased. Ann Marie Poremba, Head of Dilworth IP’s Culture and Community Committee coordinated the Firm’s participation with the Salvation Army’s Major Kathi Longcoy. “I am very proud of our team’s participation in the Angel Tree Program; we had an outpouring of gifts coming in everyday;” Michael Dilworth, Founder and Managing Partner at Dilworth IP said, “it is important to me, and to our culture here, to support those who are less fortunate than we are, especially during the Holiday Season.”

Dilworth IP Presents at the SAPA-CT 4th Annual Conference

Dr. Anthony Sabatelli and Dr. Jing Zhou of Dilworth IP presented a talk entitled “Pharmaceuticals: At the Intersection of Patent and Regulatory Law” at the SAPA-CT 4th Annual Conference on Saturday, October 7th. The Sino-American Pharmaceutical Professionals Association (SAPA) was founded in 1993 as an independent and nonprofit organization seeking to bridge the U.S. and Chinese pharmaceutical worlds by providing training in drug research and development, creating a broad network, and hosting delegations from China. The theme of this year’s conference was “Adapting to the Changes in Biotech/Pharmaceutical Industry” and was held at the Yale School of Management from 8:00 am to 6:30 PM.

Frederick A. Spaeth, Partner at Dilworth IP, will be hosting a FREE webinar on Wednesday, November 1st at 1:00 PM (EDT). This installment in the Dilworth IP Webinar Series is entitled Strategic Approaches for Drafting NDAs: A Critical Look at ‘Standard’ Clauses and Current Trends – A 2017 Update, and will focus on providing helpful strategies for properly structuring Nondisclosure Agreements (NDAs). NDAs are used everywhere: in business, politics, religious organizations, government, etc. Templates are easy to find, but experienced users will attest that there is no universal ‘standard’ NDA. In practice, an NDA should be tailored to the situation at hand and to meet the needs of the parties involved. Otherwise, the parties may be left with an ill-fitting agreement that doesn’t reveal its flaws until a dispute is brewing. This webinar will take listeners beyond a ‘one-size-fits-all’ view for a detailed look at how an NDA can and should be structured. The discussion will touch on choosing clauses to insist on and those to let go, on agreement language that goes without saying but should sometimes be said nonetheless, on non-standard clauses for specific situations, and on recognizing when the terms needed in an NDA may be dictated by external factors. The influences of recent laws, such as DTSA (Defense of Trade Secrets Act of 2016), will be discussed as well.

Dilworth IP Partner Published in Organic Process Research & Development

Dr. Anthony Sabatelli, Partner at Dilworth IP, has co-authored an article published in the Organic Process Research & Development journal (OPR&D) with Dr. John Jasper of Molecular Isotope Technologies and Dr. Ann Pearson of Harvard University. The article, entitled “Process Patent Protection via Analysis of Stable Isotope Ratios,” considers “the possibilities afforded by stable isotope analysis for improving process patent protection in relation to pharmaceutical and other value-added products.”

Dilworth IP Partners Serves as Panelist at Digital Health Bootcamp

Dr. Anthony Sabatelli, Partner at Dilworth IP, will serve on a panel at the Digital Health Bootcamp hosted by HealthVenture. The event, which will take place from Friday July 7th through Saturday July 8th, was is designed to provide digital health start-up companies with access to leaders in the healthcare industry through a series of panels, workshops and other interactive learning programs. Dr. Sabatelli will sit on a Q&A panel which will answer questions related to customer interest and intellectual property protection.

Connecticut House Passes Bill to Foster Microbiome Sector in the State

e Connecticut House of Representatives passed S.B. 1056 Wednesday, June 7th, to “establish a working group to develop a plan to foster the microbiome sector in the state.” This bill, which will now go to the governor for consideration, aims to incentivize companies focused on microbiome science to locate to and/or pursue their projects in the State of Connecticut. It proposes that a working group be established to identify these companies, and, that among the incentives created would be an annual competition for start-up microbiome companies to take place in Connecticut. “At Dilworth IP we had early on identified the field of microbiome-based therapeutics as an up and coming research area,” Dr. Anthony Sabatelli, Partner and Chair of Dilworth IP’s Biotech and Pharmaceutical IP practice group, said, “we are very pleased that this Bill has passed the general assembly, because it demonstrates the State’s commitment to supporting this emerging technology area as an important part of Connecticut’s biotechnology future.”
